1. Acceptance of Terms

By accessing or using the Cycle Sages website (cyclesages.com), mobile repair services, online shop, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Description of Services

Cycle Sages provides:

  • Mobile Bicycle & E-Bike Repair: On-site repair and maintenance services at your home, office, or trail in the Orlando, FL metropolitan area
  • Online Shop: E-commerce sales of bicycle parts, accessories, and related products
  • AI Chat Assistant: An AI-powered assistant ("The Cycle Sage") providing informational responses about our services, pricing, and general bicycle maintenance
  • Customer Portal: Account management, service history, quotes, invoices, and rewards tracking
  • Rider Rewards Program: A loyalty points program for returning customers

3. AI Assistant Disclaimer

The AI chat assistant provides general informational responses only. AI-generated content does not constitute professional mechanical advice, diagnosis, or repair recommendations.

  • Always consult a qualified bicycle technician before making repair or maintenance decisions based on AI responses.
  • Cycle Sages is not liable for any damage, injury, or loss resulting from actions taken based on AI assistant responses.
  • The AI assistant may occasionally provide inaccurate or incomplete information. Verify critical details with our team.
  • Pricing, availability, and service details provided by the AI are estimates and subject to confirmation by our staff.

4. User Accounts

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.

5. Service Estimates & Appointments

  • Estimates provided through our website or AI assistant are preliminary and subject to change upon physical inspection of your bicycle or e-bike.
  • Final pricing will be confirmed before any work begins.
  • Electronic signatures on estimate approvals constitute binding agreement to the quoted scope of work and pricing.
  • Cancellations must be made at least 2 hours before a scheduled appointment. Repeated no-shows may result in account restrictions.

6. E-Commerce & Shop Purchases

Orders & Pricing

  • All prices are listed in US Dollars and are subject to change without notice.
  • We reserve the right to cancel orders due to pricing errors, stock unavailability, or suspected fraud.
  • Applicable sales tax will be added at checkout as required by Florida law.

Returns & Refunds

  • Unused, unopened items may be returned within 30 days of purchase for a full refund.
  • Items must be in original packaging and condition.
  • Custom or special-order items are non-refundable.
  • Shipping costs are non-refundable unless the return is due to our error.
  • Refunds are processed to the original payment method within 5–10 business days.

Shipping

Shipping times and costs are estimated at checkout. Cycle Sages is not responsible for delays caused by carriers or customs processing.

7. Payment Terms

All payments are processed securely through Square. By making a payment, you agree to Square's terms of service. We do not store credit card or payment card data on our servers. Payment is due upon completion of services unless otherwise agreed in writing.

8. Identity Verification

For fraud prevention, first-time electronic payments (credit or debit card) require a one-time identity verification:

  • We scan the barcode on the back of your driver's license to verify that your identity matches the billing information on your payment method.
  • No photographs or images of your license are captured, stored, or transmitted. Only the encoded barcode data is read.
  • Once verified, your account is marked as "ID Verified" and no further scanning is required for future transactions.
  • Our staff may verify your identity manually in person as an alternative to barcode scanning.
  • The "Scan Driver's License" feature on our estimate form reads the barcode solely to auto-fill your contact information. No ID data or images are stored from this process.

9. Gift Cards

  • Gift cards are non-refundable and cannot be exchanged for cash (except where required by law).
  • Gift cards do not expire.
  • Lost or stolen gift cards cannot be replaced.
  • Gift cards may be used for any Cycle Sages service or shop purchase.

10. Rider Rewards Program

  • Points are earned on qualifying purchases and services as described in the program details.
  • Points have no cash value and cannot be transferred or sold.
  • Cycle Sages reserves the right to modify, suspend, or terminate the rewards program at any time with reasonable notice.
  • Fraudulent activity will result in forfeiture of all points and account termination.
  • Rewards and discounts may have expiration dates as specified when earned.

11. Intellectual Property

All content on the Cycle Sages website, including text, graphics, logos, images, and software, is the property of Cycle Sages and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

12. Limitation of Liability

To the fullest extent permitted by Florida law:

  • Cycle Sages provides its website and AI assistant on an "as is" and "as available" basis without warranties of any kind.
  • We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.
  • Our total liability for any claim arising from these Terms or our Services shall not exceed the amount you paid to Cycle Sages in the 12 months preceding the claim.
  • We are not responsible for any damage to your bicycle, e-bike, or property that occurs outside the scope of our agreed-upon services.

13. Indemnification

You agree to indemnify and hold harmless Cycle Sages, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our Services, violation of these Terms, or infringement of any third-party rights.

14. Dispute Resolution

Any disputes arising from these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Orange County, Florida, in accordance with the rules of the American Arbitration Association.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in the courts of Orange County, Florida.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated "Last Updated" date. Your continued use of our Services after changes are posted constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
